The National Company Law Appellate Tribunal (NCLAT) will decide on January 23rd regarding Meta’s appeal against a Rs 213.14 crore penalty imposed by the Competition Commission of India (CCI) for alleged anti-competitive practices related to WhatsApp’s privacy policy. Meta’s lawyers, Kapil Sibal and Mukul Rohatgi, argued that the CCI overstepped its jurisdiction as the issue was already under the Supreme Court’s review and would become irrelevant once the Data Privacy Law takes effect in 2025. However, CCI’s lawyer, Samar Bansal, stated that the cases were separate. In 2021, Meta revised WhatsApp’s privacy policy, requiring users to share data with other Meta entities, which the CCI considered an abuse of dominant market position.
